GENERAL TRANSIT CONDITIONS of DDA Flight Support Foundation – April 2024

The DDA CLASSIC AIRLINES Foundation has its DC-3 Dakota flights operated by the DDA FLIGHT SUPPORT, hereinafter referred to as “DDA.”
DDA Flight Support has an Airline Operator Certificate issued by IL&T on May 15, 2019.

Transportation Agreement

Purchase of a ticket for a DDA flight constitutes a contract of carriage with DDA to which the “General Conditions of Carriage of DDA Flight Support Foundation” apply. These are published on the website www.dutchdakota.nl, can be sent upon request and are included in abbreviated form in the ticket.

Booking
Booking for a DDA flight is done through the website www.dutchdakota.nl. By doing so, the booker accepts DDA Flight Support’s General Conditions of Carriage and DDA Classic Airlines’ Privacy Statement.
If a passenger falls under the Special Categories of Passengers (SCPs), such as limited mobility, use of medical equipment, pregnancy, the Reservations Department should be contacted, res@dutchdakota.org. The DDA determines whether to accept the passenger.
If an infant or child travels as a passenger, the following rules apply:
An infant who is between 0 and 2 years old on the date of travel must be accompanied by a person with a minimum age of 16 years. Infants must be placed on the lap of the accompanying passenger.
A child is a passenger who is between 2 and 12 years old on the date of travel. From the age of 12, a passenger is considered an adult. A child aged 6 years or younger must be accompanied by a person with a minimum age of 16 years.
Upon confirmation by DDA that the booking has been accepted and receipt of payment of the applicable fee, the booking is final.
Scope

Applicable are the “GENERAL TRANSIT CONDITIONS of DDA Flight Support Foundation for passengers and their baggage on DDA-Dakota flights.” These terms and conditions apply to all transportation of passengers and baggage provided by DDA, whether for payment or free of charge, including related (transportation) services.
The invalidity of any provision in these terms and conditions due to possible conflict with mandatory law does not affect the validity of the remaining provisions.

Ticket

This is the document labeled “Ticket” and/or the electronic ticket issued by DDA. The ticket, unless proven otherwise, serves as proof of the conclusion of the contract of carriage and is not transferable.

Check in

In order to complete government-mandated formalities and exit procedures in a timely manner prior to flight departure, the passenger must have the required travel documents and report to the check-in desk and gate within the deadline specified by DDA. If the passenger is at fault, DDA has the right to cancel the booking and is not bound to delay the flight, while it is not liable for any resulting damages or costs to the passenger and is not bound to reimburse the ticket cost.

Change of flight schedule

Times and landing locations mentioned in the ticket, flight schedule or elsewhere are not guaranteed. Force majeure and other weighty circumstances may be reasons to deviate from the flight schedule, for example due to operational, technical or safety considerations, including – but not exhaustively – weather conditions, instructions from air traffic control, strikes, etc. Costs incurred by the passenger as a result of the non-performance or late performance of a (return) flight will be borne by the passenger.

Cancellation

1. By DDA:
DDA may decide to cancel the flight in case of force majeure and other serious circumstances. The execution of a flight depends on the operational deployability of the unique aircraft used by DDA as well as weather conditions, the availability of specially trained crew and a minimum number of passengers. In this case, the passenger will be informed immediately after the cancellation decision and an alternative flight will be sought in consultation with the passenger or the fare paid will be refunded. If these circumstances arise during the trip, DDA will make every effort to ensure the safe and prompt return of the aircraft and passengers. In the latter case, the fare paid for the unused portion of the trip will be refunded to the extent that DDA saves costs as a result of the cancellation.

2. By the passenger:
The passenger is due:

  • for cancellation up to 28 days before departure: 15% of the rate paid with a minimum of €50;
  • for cancellation from the 28th day to the 5th day before departure: 50% of the rate paid;
  • for cancellation from the 5th day to 1 day before departure: 75% of the rate paid and
  • for cancellation on the day of departure: 100% of the rate paid.
Luggage
  1. The passenger can only carry personal items of small size as hand luggage: a handbag, photographic, film and video equipment of limited size, overcoat, umbrella or walking stick. For overnight flights, luggage is allowed up to a weight of 6 kg and the maximum dimensions of 55x35x25 cm.
  2. Aids needed by the passenger to get around can only be taken after DDA approval.
  3. The passenger himself must transport his luggage to or from the aircraft, if, for example, there is no handling (agent) present at an airport or the authorities require, due to security concerns, that the passenger himself designate his suitcase, etc.
  4. It is prohibited to carry the following dangerous items in baggage:
    1. objects, liquids or other substances that could pose a significant risk to health, safety or property if carried, including but not limited to explosives, pressurized gases and/or aerosols, flammable liquids, corrosive, oxidizing or radioactive materials, magnets, highly flammable materials, toxic, unpleasant smelling or irritating substances, lighters;
    2. items the carriage of which is prohibited by international treaty law, applicable laws, regulations or rules of a state to which, from which or over which is flown;
    3. items that in DDA’s judgment are not suitable for transportation because of their weight, size, shape, odor or nature;
    4. (antique) firearms, replica weapons, ammunition, swords, (cutting) knives and the like;
  5. It is prohibited to carry live animals with you or in your luggage.
  6. Electronic devices such as portable phones, laptops, radios, tablets, etc. should be on what is known as “airplane mode.
  7. The passenger is obliged to take measures to avert or reduce the imminent danger of damage.
Liability
  1. Air carriage under this Contract of Carriage, including but not limited to DDA’s liability for passengers and their baggage, shall be subject to the provisions of Title 16 Book 8 of the Civil Code (Operation of Aircraft), except where Council Regulation (EC) No. 2027/97 on air carrier liability in the event of accidents, as amended by Regulation (EC) No. 889/2002 of the European Parliament and of the Council of 13 May 2002 (OJEC L140), applies.
  2. The conditions and limitations of liability that DDA itself may invoke if the damage is not due to its fault or negligence shall apply mutatis mutandis to persons assisting in the execution of the flight – including cockpit and cabin crew, volunteers and employe(s) of DDA and their agents – provided that these auxiliary persons have acted demonstrably in the course of their employment or in the work, assignments and instructions to which they were used.
Deadlines for protest

A complaint/protest/claim for damages must be submitted in writing to DDA immediately upon discovery of the damage and no later than the time limits specified below:

  1. Regarding damage to luggage: no later than 7 days after the trip.
  2. Regarding other damages: within two years after the flight.
